By accessing or using StatKraken ("the Service"), operated by Kraken Labs, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

StatKraken is a data analytics platform that collects, aggregates, and displays publicly available information about browser-based and web games across multiple gaming platforms. The Service includes a website, API, and related tools.

3. Data Collection & Sources

All game data displayed on StatKraken is collected from publicly accessible web pages. We do not access private accounts, login-gated content, or personal user data. Our data collection practices comply with applicable law and follow established legal precedent regarding public data access. Data is labeled by source type (observed, estimated, archived).

4. User Accounts

Certain features may require account registration. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Attempt to reverse-engineer, scrape, or systematically download data from the Service beyond normal use without an API subscription
• Impersonate any person or entity, or misrepresent your affiliation
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to transmit malware, spam, or harmful content
• Resell or redistribute Service data without authorization

6. API Usage

Access to the StatKraken API is subject to rate limits and usage tiers. API keys are non-transferable. Abuse of the API, including exceeding rate limits or unauthorized redistribution of API data, may result in access revocation.

7. Intellectual Property

The Service, including its design, code, analytics methodology, and derived metrics, is the intellectual property of Kraken Labs, LLC. Game metadata, titles, and descriptions displayed on the Service belong to their respective owners. Our use of this publicly available information is for informational and analytical purposes.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or timeliness of any data. Game metrics are based on publicly available information and may not reflect actual performance. Estimated and interpolated data points are labeled as such.

9. Limitation of Liability

To the maximum extent permitted by law, Kraken Labs, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Takedown Requests

If you are a platform operator or game developer and believe your data should not appear on StatKraken, please contact us. We take takedown requests seriously and will respond within 5 business days.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of California.
